Promotional Period

From 22/07/2020 to 04/08/2020 AEST or while stocks last. The Promoter may extend the Promotional Period at its sole discretion.

Claim Restrictions

Redemption is only open to Australian residents aged 18 or over who are a registered Woolworths Rewards member.

Participating Product

The Participating Products are any L’OR espresso capsule (double and single shots) purchased during the Promotional Period from the Participating Woolworths Stores.

Redemption Product

The Redemption Product is either:

·       L’OR Barista Capsule Machine Piano Noir Latte (LM8014/60) valued at AUD $219 of which there are 1500 available for redemption during the Promotional Period (Machine Latte); or

·       L’OR Barista Capsule Machine Latte Premium (LM8018/90) (Machine Latte Premium) valued at AUD $249 of which there are 2500 available for redemption during the Promotional Period.

There are a total of 4000 machines available during the Promotional Period. 

 

Redemption Machine Allocation

The Redemption Product can be redeemed in-store at one of the 50 In-Store Redemption Stores (12 Machine Latte Premiums only per store) or online via the Claim Method. Allocation of machines is as follows:

·       In-store Redemption Product:  There are 12 Machine Latte Premiums physically available for redemption in each of the 50 In-Store Redemption Stores (600 machines in total). 

·       Online Redemption Product:  The remaining 3400 machines are available for redemption online via the on-line Claim Method   The first 1900 online claimants will receive a Machine Latte Premium. The remaining 1500 online claimants will receive a Machine Latte.

Participating Woolworths Store

The participating stores are all Woolworths Group Limited Stores in Australia (including Woolworths Metro stores) which stock the Participating Products, and Woolworths Online at www.woolworths.com.au (Woolworths Online). Caltex/Woolworths co-branded Metro stores and fuel outlets are excluded from the Promotion

In-Store Redemption Store

The following 50 Participating Woolworths Stores will each have 12 Machine Latte Premium machines available for in-store redemption.  These are available while stocks last in each store.

Offer

The first 4000 Woolworths Rewards members to purchase AUD $120 worth of Participating Products from Participating Woolworths Stores during the Promotional Period will be eligible to receive a Redemption Product.  The availability and type of Redemption Product will depend on what is available at the time of purchase of Participating Product and whether redemption is via in-store or online (as set out under the Redemption Machine Allocation and Claim Method).

Minimum Spend

The Redemption Product cannot be redeemed with purchases of less than AUD $120.  A claimant must spend at least AUD $120 in one transaction in order to claim the Redemption Product.

Claim Method

To claim the Offer, claimants must, during the Promotional Period:

1.      Spend $120 in one transaction on Participating Products at Participating Woolworths Stores AND scan their registered Woolworths Rewards card or enter their Woolworths Rewards card number at the checkout if purchasing Participating Products at Woolworths Online.

If claimants do not scan or enter the number of their registered Woolworths Rewards card (as applicable), they will not be eligible for this Promotion.

2.      If the Redemption Product is available in the Participating Woolworths Store at point of purchase, scan the Redemption Product at check out with their Participating Products and Woolworths Rewards card.

If the Redemption Product is physically unavailable at one of the Participating Woolworths Stores (as they may have already been redeemed) or Participating Product is bought at Woolworths Online, the claimant will be sent an email to the email address linked to the Woolworths Rewards card scanned or entered at checkout from L’OR espresso by 19/8/2020 outlining the process for Redemption Product redemption online. The claimant will then have until 9/9/20 to redeem the allocated Redemption Product (Redemption Period).  No Redemption Products will be able to be redeemed after the Redemption Period. Once the claimant’s delivery address has been confirmed, delivery of the Redemption Product will occur within approximately 3 to 4 weeks from the date of the confirmation of the address.

Maximum Claims Permitted

A maximum of one claim per claimant applies. 

Other Conditions

By entering this Promotion, the claimant agrees to Woolworths sharing the contact details listed in their Woolworths Rewards account with L’OR espresso in order to be contacted directly via email by L’OR espresso as detailed under the Claim Method

The claimant agrees that if they have obtained the Redemption Product but then return any of the Participating Products they will also return the Redemption Product to the Promoter.

The claimant will ensure that its Woolworths Rewards Program contact details are current before entering into the Promotion.     

 

Standard Terms and Conditions

(a)                 Information on how to enter the Promotion and the Redemption Product on offer form part of these Terms and Conditions, which set out the requirements for the "Promotion".  Any claim not complying with these Terms and Conditions is invalid. Participation in this Promotion is deemed acceptance of these Terms and Conditions. Receiving the Redemption Product is contingent upon fulfilling all of the requirements set forth in these Terms and Conditions.

(b)                 No claims will be accepted outside of the Promotional Period and will be deemed to be received only when received by the Promoter.

(c)                 Incomplete, indecipherable or illegible claims will be deemed invalid.

(d)                 The Redemption Product is not transferable or exchangeable and cannot be redeemed as cash. Without limiting any other term of these Terms and Conditions, the Redemption Product must be taken as and when specified, or will be forfeited with no replacement. The Redemption Product values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. 

(e)                 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

(f)                  Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

(i)                   any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);

(ii)                 any theft, unauthorised access or third party interference;

(iii)                any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

(iv)                any variation in Redemption Product value to that stated in these Terms and Conditions;

(v)                 any tax liability incurred by a winner or entrant; or

(vi)                use of the Redemption Product.

(g)                 The Promoter may require the entrant to provide proof of identity, age, and residency. If any claim cannot be verified to the Promoter's satisfaction, the claim may be declared invalid.  Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.

(h)                 If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

(i)                   The Promoter reserves the right to verify the validity of any claims and may in its sole discretion disqualify any claim or refuse to award the Redemption Product to anyone who in its opinion has:

(i)                   tampered with the claim process;

(ii)                 engaged in any conduct that may jeopardise the fair and proper conduct of the promotion;

(iii)                acted in a disruptive, annoying, threatening, abusive or harassing manner;

(iv)                does anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this promotion;

(v)                 breached any law;

(vi)                behaved in a way that is otherwise inappropriate;

(vii)               has not complied with these Terms and Conditions;

(viii)             has gained any unfair advantage; or

(ix)                has received the Redemption Product by fraudulent means.

(j)                   The Promoter and any other agencies associated with this Promotion will not be responsible for any late, lost or misdirected entries. Records of the Promoter are final and conclusive at the time of receipt.

(k)                 If for any reason beyond the Promoter's reasonable control this Promotion is not capable of running as planned, for reasons including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the reasonable control of the Promoter which corrupts or affects the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion (subject to any written direction given by a relevant Regulatory Authority) to disqualify any claim, or to cancel, terminate, modify or suspend the Promotion.

(l)                   In the event of war, terrorism, state of emergency, pandemic or any other kind of  disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize/Redemption Product, subject to any written directions from a relevant regulatory authority.

(m)               If all or any part of any term or condition contained in these Terms and Conditions shall be declared or become unenforceable, invalid or illegal for any reason, such term or provision (or part thereof) shall be deemed severed from these Terms and Conditions to the extent of the unenforceability, invalidity or illegality and the other Terms and Conditions hereof shall remain in full force and effect as if the offending term or provision (or part thereof) had not been inserted herein.

(n)                 Failure to supply all requested personal information at the time of making a claim may result in the claim being invalid. The information contained in the claim process will be subject to the Promoter's Privacy Policy, available at https://shop.lorespresso.com.au/pages/privacy-policy.

(o)                 The Promoter's decision in relation to any aspect of the Promotion is final and binding on every person who enters, and no correspondence will be entered into.
